Can i visit Canada while my B2 extension is pending?
dvasu asked:
My Mom is here on a B2 visa. Her I-94 expires on June 29. We applied for an extension and the application is currently pending. She is also planning to visit my brother in Canada. Can she visit Canada now and return back to US after June 29, if her extension is granted. If for some reason, her extension is not granted, she will return to India from Canada. We don’t want to take a chance and stay in the US beyond June 29, if the extension is not processed by then.

I was in the U.S. on a B2 visa and called their customer service centre a million times to make sure I was doing everything legally. As long as you send in the application before your visa expires, you can stay in the U.S. up until 240 days, or until they deny you. Whatever one happens first. I’m not sure if she can leave the U.S. and come back. If I am correct, leaving the U.S. will end up making your I-539 useless. But don’t take my word for it on that part. Call their customer service line. They are very friendly and helpful there.

Good luck.
(I don’t think you get proof that your case is pending. You get a receipt, but that’s not proof that it’s still pending. It’s only proof that you filed the extension.)
She can present her proof of extension filing to the CBP officer at the border. Extensions of stay are not cancelled when one leaves the country. However, changes of status will become null and void.
